Terms & Privacy Policy

This Combined Privacy Policy and Terms of Use ("Agreement") governs your access to and use of the mobile and web application "Dattle" ("App"), operated by Accumulus Corporation ("Company," "we," "us," or "our"). The App enables users to collect data and process it using external artificial intelligence ("AI") processors, including OpenAI, Anthropic, and xAI. We may display advertisements within the App.

Users may categorize data collections as Private, Shared, or Public. Private data collections are stored solely on the user's device and are not backed up, stored in the cloud, or transmitted to our servers or third parties, except as necessary for temporary AI processing if initiated by the user. AI providers process data under their own privacy policies. Shared data collections are stored in cloud storage and may be shared with other users based on permissions set by the owner. Public data collections are stored in cloud storage and are openly accessible to all App users.

By accessing or using the App, you agree to be bound by this Agreement. We reserve the right to modify this Agreement at any time. Your continued use after changes constitutes acceptance.

1. Terms of Use

1.1 Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use the App. By using the App, you represent that you meet these requirements.

1.2 User Accounts

To access certain features, you may need to create an account. You agree to provide accurate information and keep it updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately of any unauthorized access.

1.3 License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes, subject to this Agreement. You may not modify, reverse engineer, or create derivative works from the App.

1.4 User Content and Data Collection

You may upload, input, or collect data ("User Content") through the App for processing via external AI processors. For Private collections, User Content remains on your device except for temporary transmission to AI processors if you choose to process it. For Shared and Public collections, User Content is stored in the cloud and may be shared with or contributed to by other users.

You retain ownership of your User Content but grant us a worldwide, royalty-free license to use, store, process, and transmit it as necessary to provide the App's services, including sharing with third-party AI providers (OpenAI, Anthropic, xAI), ad networks, and other users for Shared or Public collections.

Prohibited Data Types in Shared and Public Collections: You are strictly prohibited from uploading, storing, or sharing the following in Shared or Public collections:

Personal health information (e.g., medical records, diagnoses, genetic data, or biometric health metrics), as defined under HIPAA
Financial information (e.g., bank account numbers, credit card details, or credit reports)
Government-issued identifiers (e.g., Social Security numbers, driver's license numbers)
Sensitive personal data (e.g., racial or ethnic origin, religious beliefs, sexual orientation, or criminal records)
Children's personal information (under 13 years old), in compliance with COPPA

1.5 Prohibited Conduct

You agree not to:

Use the App for illegal purposes or to violate any laws
Upload harmful content, including malware, viruses, or infringing material
Interfere with the App's operation or other users
Collect or harvest data from other users without consent
Use automated systems (e.g., bots) to access the App without permission
Engage in commercial activities without our consent
Share User Content in Shared or Public collections without obtaining necessary consents from data subjects
Attempt to access or modify Private collections of other users

1.6 Advertisements

We may display third-party advertisements in the App. We are not responsible for the content, accuracy, or privacy practices of advertisers. Ads may be personalized based on usage data, but not from Private collections.

1.7 Intellectual Property

The App, including its design, features, and underlying technology, is owned by us or our licensors and protected by U.S. copyright, trademark, and other intellectual property laws. You may not use our trademarks without permission.

1.8 Termination

We may suspend or terminate your access to the App at any time for any reason, including violation of this Agreement. Upon termination, your license ends and you must cease using the App.

1.9 Disclaimers and Limitations of Liability

The App is provided "as is" without warranties. We disclaim all warranties, express or implied, including fitness for a particular purpose. To the extent permitted by law, we are not liable for indirect, consequential, or punitive damages arising from your use of the App. Our total liability shall not exceed $100.

1.10 Governing Law and Dispute Resolution

This Agreement is governed by the laws of the State of Oregon. Any disputes shall be resolved through binding arbitration in Portland, Oregon, under the rules of the American Arbitration Association, except for small claims.

1.11 Miscellaneous

If any provision is unenforceable, the remainder remains in effect. This Agreement constitutes the entire understanding between you and us.

2. Privacy Policy

We are committed to protecting your privacy. This Privacy Policy explains our practices regarding personal information under U.S. laws, including the California Consumer Privacy Act (CCPA) and other applicable regulations.

2.1 Information We Collect

Personal Information: Name, email, device ID, IP address, and payment information (if applicable)
User Content: Data you collect or input for AI processing, which may include text, images, or other files. For Private collections, this is stored only on your device; for Shared and Public collections, it is stored in the cloud.
Usage Data: App interactions, location (if enabled), browser type, and crash reports
Advertising Data: Data for targeted ads, such as interests inferred from usage (excluding Private collections)

We do not knowingly collect data from children under 13 without parental consent, in compliance with COPPA.

2.2 How We Use Your Information

To provide and improve the App's services, including data processing via external AI
To enable sharing and contributions for Shared and Public collections based on your permissions
To personalize your experience and display relevant ads
For analytics, security, and fraud prevention
To communicate with you (e.g., updates, support)
To comply with legal obligations

2.3 Sharing Your Information

We share information with:

External AI Processors: OpenAI, Anthropic, and xAI to process your data. Each provider processes data under their own privacy policy.
Permitted or Public Users: For Shared collections, with other users based on your permissions; for Public collections, with all App users
Ad Networks: Partners like Google Ads for targeted advertising
Service Providers: For hosting, analytics, cloud storage, and payment processing
Legal Requirements: If required by law, subpoena, or to protect rights

We do not "sell" your personal information as defined under CCPA, but we may share for targeted advertising, which you can opt out of.

2.4 Cookies and Tracking Technologies

We use cookies, pixels, and similar technologies for functionality, analytics, and ads. You can manage preferences via device settings or opt-out tools (e.g., NAI opt-out).

2.5 Data Security

We implement reasonable security measures to protect your data, but no system is 100% secure. For Shared and Public collections, cloud storage uses encryption and access controls.

2.6 Your Rights

Under CCPA and similar laws, you have the right to:

Access, delete, or correct your personal information
Opt out of sharing for targeted ads
Limit use of sensitive personal information
Revoke consents for data processing or sharing via in-app settings

To exercise these rights, contact us at the address below. We respond within 45 days. For EU users (if applicable), we comply with GDPR rights.

2.7 Data Retention

We retain data as needed for services, legal compliance, or business purposes, typically no longer than 2 years after account inactivity. Private collections are managed by you on-device; Shared and Public collections are deleted upon owner request or account termination.

2.8 International Transfers

Data may be transferred to the U.S. or other countries. We ensure adequate protections.

2.9 Third-Party Links

The App may link to third-party sites. We are not responsible for their practices.
